सुप्रीम कोर्ट में एक गंभीर आरोप

 


कुछ  दिन पहले, BJP MP डॉनिशिकांत दुबे ने सुप्रीम कोर्ट में एक गंभीर आरोप लगाते हुए कहा:

अगर इस देश में कोई धार्मिक हिंसा भड़काने के लिए ज़िम्मेदार हैतो वह सुप्रीम कोर्ट और उसके जज हैं!”


उनके इस बयान से बड़ा विवाद हुआ और विपक्षी पार्टियों ने उनकी कड़ी आलोचना की। हालांकिजाने-माने साइंटिस्टलेखक और स्पीकर आनंद रंगनाथन ने दुबे का पूरा सपोर्ट करते हुए एक वीडियो स्टेटमेंट जारी किया। 


रंगनाथन ने धाराप्रवाह इंग्लिश में सुप्रीम कोर्ट से 9 कड़े सवाल पूछे। ये सवाल बहुत ज़रूरी हैं। नीचे हिंदी में एकछोटी समरी दी गई है जिसे अब सभी को साफ-साफ समझने के लिए इंग्लिश में ट्रांसलेट किया गया है और सबसे नीचे प्रस्तुत किया गया है

1. `कश्मीर के मुद्दों पर दोहरे मापदंड:` सुप्रीम कोर्ट ने जम्मू-कश्मीर को स्पेशल स्टेटस देने वाले आर्टिकल 370 को हटाने के खिलाफ विपक्षी पार्टियों की पिटीशन पर तुरंत सुनवाई की।  लेकिन जब 1990 के दशक में कश्मीरी हिंदुओं पर हुए अत्याचारों के बारे में पिटीशन फाइल की गईंजैसे ज़बरदस्ती हटानाघरों पर कब्ज़ा करनामंदिरों को तोड़नाहत्याएंरेप और बड़े पैमाने पर पलायनतो कोर्ट ने उन्हें यह कहते हुए खारिज कर दिया, “यह बहुत पहले हो चुका है।” *क्या यह दोहरा रवैया नहीं हैक्या इससे हिंदुओं में गुस्सा नहीं पैदा होताक्या यही धार्मिक झगड़े की वजह नहीं बनता?


2. `वक्फ बोर्ड के गलत इस्तेमाल पर चुप्पी:` सुप्रीम कोर्ट अब वक्फ बोर्ड के सुधारों को लेकर परेशान है। लेकिन पिछले 30 सालों मेंवक्फ बोर्ड ने गैर-कानूनी तरीके से प्रॉपर्टी ज़ब्त की हैटैक्स बचाया हैऔर एक पैरेलल ज्यूडिशियल सिस्टम चलाया हैफिर भी कोर्ट चुप रहा। अगर सुधारों को इस्लाम के लिए खतरा माना जाता हैतो हिंदुओं की ज़मीन पर मस्जिदें और दरगाह बनाना कैसे मंज़ूर थावक्फ बोर्ड ने 2 मिलियन से ज़्यादा हिंदुओं की प्रॉपर्टी ज़ब्त कर लीं। सुप्रीम कोर्ट चुप रहा।  *अगर यह धार्मिक भेदभाव नहीं हैतो क्या है?


3. `मंदिर का पैसा कहीं और इस्तेमालहिंदुओं पर रोक:` हिंदू मंदिरों पर सरकार का कंट्रोल है। उनकी इनकम मदरसोंहज यात्राओंवक्फ बोर्डइफ्तार दावतों और लोन के लिए इस्तेमाल होती है। लेकिन हिंदुओं के धार्मिककामों पर रोक है। हिंदुओं के अधिकारों से जुड़ी पिटीशन अक्सर खारिज कर दी जाती हैं। माइनॉरिटी को हमेशाखास प्राथमिकता दी जाती है। *क्या यह सही हैया यह हिंदुओं का गुस्सा भड़काने का एक तरीका है?


4. `हिंदुओं के खिलाफ एजुकेशन में भेदभाव:` राइट टू एजुकेशन एक्ट के तहतहिंदू स्कूलों में माइनॉरिटी के लिए25% सीटें रिज़र्व होनी चाहिए। लेकिन मुस्लिम और ईसाई इंस्टीट्यूशन इस नियम से बाहर हैं। हज़ारों हिंदू स्कूलबंद हो गएऔर हिंदू बच्चे अब गैर-हिंदू इंस्टीट्यूशन में पढ़ते हैं। *क्या यह धर्म बदलने को बढ़ावा नहीं दे रहा हैसुप्रीम कोर्ट इस एकतरफ़ा नियम को क्यों नहीं देखता?


5. `फ्री स्पीच का दिखावा:` जब हिंदू बोलते हैंतो उसे “हेट स्पीच” कहा जाता है।  जब दूसरे बोलते हैंतो इसेबोलने की आज़ादी” कहा जाता है। नूपुर शर्मा ने सिर्फ़ हदीस से कोट कियाऔर कोर्ट ने इसे हेट स्पीच कहा।लेकिन जब स्टालिन और दूसरे नेताओं ने सनातन धर्म को “बीमारी” कहातो कोर्ट चुप रहा। *क्या यह इंसाफ़ है?


6. `हिंदू परंपराओं पर भेदभाव वाली रोक:` सुप्रीम कोर्ट दशहरा पर जानवरों की बलि जैसी हिंदू रस्मों पर रोकलगाता है। लेकिन ईद के दौरान बड़े पैमाने पर हलाल जानवरों को मारने पर कोई सवाल नहीं उठाया जाता।जन्माष्टमी के दौरानदही हांडी के जश्न में ऊंचाई की पाबंदी होती है। लेकिन मुहर्रम से जुड़ी हिंसा के खिलाफकोई कार्रवाई नहीं की जाती। दिवाली के पटाखों को पर्यावरण के लिए नुकसानदायक कहा जाता हैलेकिनक्रिसमस की आतिशबाजी की कोई बुराई नहीं होती। *क्या यह भेदभाव नहीं है?


7. `पूजा स्थल एक्ट हिंदू बहाली को रोकता है:` 1991 का पूजा स्थल एक्ट कहता है कि 15 अगस्त, 1947 केहिसाब से जगहों का धार्मिक चरित्र नहीं बदला जाना चाहिए। यह कानून हिंदुओं को उन पुराने मंदिरों को वापसपाने से रोकता है जिन्हें तोड़ दिया गया था या बदल दिया गया था। राम मंदिर के लिए कई दशकों तक लड़ाईलड़नी पड़ी।  कई दूसरे मंदिरों पर कब्ज़ा है। *क्या यह ऐतिहासिक अन्याय नहीं है?


8. `सिर्फ़ हिंदू परंपराओं को निशाना बनाना:` सबरीमाला मामले मेंकोर्ट ने हिंदुओं की भावनाओं को ठेसपहुँचाई। कुछ हिंदू मंदिरों में सिर्फ़ पुरुषों या सिर्फ़ महिलाओं के रीति-रिवाज़ माने जाते हैं। लेकिन कोर्ट ने सिर्फ़हिंदू परंपराओं पर सवाल उठाए। इस्लाम मेंऔरतें मस्जिदों में नहीं जा सकतीं या कुछ जगहों पर कुरान नहीं पढ़सकतीं। ईसाई धर्म मेंऔरतें पुजारी नहीं बन सकतीं। *कोर्ट ने उन धर्मों पर सवाल क्यों नहीं उठाए?


9. `एंटी-CAA प्रोटेस्ट के दौरान कोई कार्रवाई नहीं:` शाहीन बाग प्रोटेस्ट और एंटी-CAA दंगों के दौरानसुप्रीमकोर्ट ने कोई कड़ी कार्रवाई नहीं की। प्रोटेस्ट करने वालों ने पब्लिक सड़कें ब्लॉक कर दींलेकिन कोर्ट ने इसे नहींरोका। *क्या यह कानून का मज़ाक नहीं हैक्या इससे भी हिंदुओं का गुस्सा नहीं बढ़ा?*

During massive public blockades like the Shaheen Bagh anti-CAA protests, the Supreme Court failed to enforce immediate law and order to clear public roads. Ranganathan asserted that this passive stance erodes the public's faith in the rule of law and breeds deep-seated frustration.
