Bank Unions IBA and Retirees

साथियो नमस्कार
यह कहावत हम बचपन से सुनते आए हैं कि अब पछताए क्या होत है जब चिड़िया चुग गई खेत, आजकल पाकिस्तान से टिड्डी दल हमारे खेतों पर आया हुआ है और वह भी खेतों को वैसा ही नुकसान तो जा रहा है जैसा कि उपरोक्त कहावत में कहा गया है  

अब हम अपनी व्यथा पर आते हैं हमारे भी अति व्यथा यह है कि हमारे नेता भी उसी तरह रिटायरी को सभी  वास्तव में मिलने वाली सुविधाओं को चट करने में लगे हुए हैं,जैसे टिड्डीदल, हम तुलना करे जो सुविधा सेंट्रल सिविल पेंशनर्स को मिल रही है, जो रिजर्व बैंक ऑफ इंडिया में मिल रही है , और जो हमारे सेटलमेंट 29 अक्टूबर 1993 के अनुसार हम सब को मिलनी चाहिए थी।
वे क्यो नही मिल पा रही है ?

शायद दुनिया में सबसे कम फैमिली पेंशन ₹175 बैंक रिटायरीज के लिए बैंको मे ही है,  ब्रिटिश राज में भी हर 10 वर्ष बाद पेंशन/ अनुकम्पा का रिवीजन कर देते थे जो पेंशन अनुकंपा के आधार पर दी जाती थी, परंतु बैंक रिटायरीज को उनका पैसा जमा होने के बावजूद उनका एंटाईटेल्मेंट होने के बावजूद भी पेंशन में पिछले 27 वर्षों में कोई भी रिवीजन नहीं किया गया है।  कितनी दुखदः स्थिति है ?
न्यूनतम सरकारी व अनुकम्पा पेन्शन से भी कम पारिवारिक पेन्शन बैंकौ मे है,क्यो -????

 यह नाइंसाफी की पराकाष्ठा है सुप्रीम कोर्ट के अनेक निर्णय जिनमें स्पेशलिस्ट को 5 साल का नोशनल बेनिफिट देना या  1616- 1684 के अंतर्गत कम्यूटेशन का पेमेंट करना या स्पेशल "पै" पर पेंशन की गणना करना और  समान डेट से ग्रेच्युटी का भुगतान करना,एक समान DA देना, ऐसे ऐसे बिंदु हैं जिन पर नेताओं को साँप सूंघ गया है,मूँह पर ताला लगा है ,क्यो-????

 दुनिया में कहीं भी वृद्ध जनों के लिए इतनी महंगी इंश्योरेंस पॉलिसी नहीं है जितनी महंगी इंश्योरेंस पॉलिसी रिटायरी के ऊपर इस गठजोड़ ने जो एआईबीईए और आईबीए ने किया है लाद दी है, धीरे-धीरे पेंशनर उससे बाहर होते जा रहे हैं जहां तक घरेलू उपचार सुविधा के साथ इंश्योरेंस लेना
व प्रीमियम देना घाटे का सौदा है, और शायद ही कुछ लोगों ने यह गलती की हो और आगामी सालों में इसको कोई भी नहीं लेगा यह 100% निश्चित है,  ऐसी स्कीम लागू करने का क्या लाभ है जिसको कोई लेने के लिए तैयार ही नहीं है-? जो उनके ऊपर एक बोझ के समान है और उनको किसी प्रकार की कोई सुविधा नहीं मिल रही है। धिक्कार है...                       

 लाखों बीमाधारी ऐसे हैं जो लगातार प्रीमियम भर रहे हैं और जिन्होंने 1 नए पैसे की भी कोई सुविधा इस इंश्योरेंस कंपनी से नहीं ली है, फिर भी क्लेम देने में यह इंश्योरेंस कंपनी Retirees को बहुत ही तंग करती है-ऐसा क्यो है-?????            

  अति आवश्यक है इस सारी व्यवस्था में बदलाव किया जाए और बदलाव के लिए नेताओं के ऊपर दबाव डाला जाए मक्कार  नेताओं को धक्के मार कर हटाया जाए ,
यदि ऐसा नही किया
गया तो कुल रिटायरज के 15%  ही स्कीम मे रह जावेगे, जो दुर्भाग्य पूर्ण होगा।               अतः प्रिमियम बैंक एक समान दे,स्वमं P&L से दे तो प्रिमियम 60% से अधिक कम हो जावेगा, तब व्यवसायिक हित सामने होगे,स्पर्धा होगी,
जैसा अन्य PSU /pvt कम्पनीयों मे है
यही हमारी मांग है,कमीशन खोरी बन्द हो,न्याय पूर्ण प्रिमियम हो जैसा अन्य PSU भुगतान कर रहे है

Danendra Jain: You are right.  But retirees have no right to say to unions because their relationship  ends with unions when they retire from their bank. Similarly  they have no right to say anything  to IBA because CMD of participant banks authorise IBA only to have dialogue on dotted lines,  on wage revision  of bank working employees,  not for retirees.  

However whatsoever  is agreed upon for terminal benefits payable to  working employees before their retirement  become their entitlement after retirement too.  

Obviously  if any change  occurs in Bipartite Settlements,  it will be applicable  to future retirees only. This is as per my understanding,  I may be wrong. 

If retirees want further improvement  in their pension or in benefits available  post retirement  , they have to approach either head of each bank, or Government of India or approach Court of law depending  upon nature of their demands and prevailing  situations .  

Indian Banks Association IBA will never listen to demands like updating pension of old retirees,  change in DA structure, effective  dates for enhanced gratuity entitlement , insurance  premium  etc.  For these changes which are called basic changes have to be accepted  by the government  or to be ordered by competent  court of law. 

Before every settlements,  retirees used to and always put their demands before UFBU and IBA but they were/ are never given due attention by either UFBU or IBA .

Therefore, we retirees have to hire efficient, honest, sincere, devoted and talented team of advocates  to fight our case in court of law.  We have to support  each such cases pending in courts at various places,   monitor them,  help them financially  if needed,  add our experiences  and knowledge  if needed and more particularly  refrain from criticising  petitioners who have already filed cases somewhere  or the other on some issue or the other. 

It is unfortunate  that number of retiree  groups has been increasing  year after year  instead  of consolidation  and unification  of them. Every retirees know very well that government  gives value to majority unions and groups and consider demands positively if found suitable  by them. Or else mass agitation  become inevitable. 

 If Our well wishers are divided from their heart for their individual  ego,  it is but natural that our fight for justice gets punctured and as a result, Government,  bank unions,  bank heads and IBA , all take advantage  of it.

: What a misconception retirees have in their mind regarding  Presentation of their issues before the management.There are two judgements from High Court Madras and High Court Kolktta that pensioners can also have their trade union Rights protected and their unions can be registered under trade union act 1947 & have right to represent & negotiate their issues.  On this basis many bank wise Unions  are registered under trade union act 1947.   

AIBRF is also registered under trade union act. Many State units, particularly in Gujarat & West Bengal are registered under trade union act . All these can raise our issues before CLC Or with High Court, Supreme court and before the Bank Management. 

Management cannot refuse to talk to them, if they prove their majority, because if they are the retirees majority Unions,  management have to talk to them, if they don't talk we can get directions from the court to talk and resolve the issues.

  So first of all this concept is to be removed from mind that only the working union can talk on our issues. Now naturally a question arise that why we have not done it so far, the answer is that the Retirees top leaders do chamchagiri of the working union as they are already established as representative Union. They presume that through working  we can get our issues resolved. which has proved totally wrong .

We know both IBA & WORKING Unions are financially very Sound. So,they always try & show retiral benifits are covered in BPS. But it is not Correct. Bank Pensioners have to establish their unity & right to negotiate, thing will start changing immediately. But apex union leaders have wasted our time,energy & money in meeting, eating, travelling & their comforts only.

Dear 

I disagree to some extent that we cannot blame union.  Unions are responsible for making incomplete defective agreement. 

If they want to take second pension option , they pursue for mandate from all banks and get it executed whether wrong of right. If they want to start IBA medical scheme, they are fully involved and get it done.

So dear, if they want, they can pursue for formal mandate from banks for  discussion for pension revision.

Only question is of their intention.

Even , the biggest retirees union to be claimed by SC Jain, he is the biggest follower of AIBEA . He could not get it done because he was never serious.

The root Cause of the Problem is that we want others to do for us,while legally   we can do it as of our own.             

Had AIBRF tried to become a party to negotiation in BPS instead buttering CHV,many of the Problems would have solved by now.                      

But buttering  is easy, while fighting is difficult, So, Jain took easy route & ruined 100% DA Case, now trying to ruin Commutation of Pension Payment as per SC Order 28-8-2019 as doing Chamchagari of IBA . By Chamchagiri you are  at the mercy of others , in fight you achieve as your victory, Choice is yours

Danendra Jain: We all retirees  worked in their respective  banks for three decades and more and they are well acquainted  with intentions, attitude  and real work of them.  Had they been serious, honest and devoted,  they could have raised the issue of gratuity  discrimination  decades ago,  had they been serious on updating  pension of pensioners, they could have done decades ago,  had they been serious on unjustified insurance  premium burden on pensioners, they could have done it during last BS. 

Even for getting second option for pension,  they took years and finally sold it after taking a large portion  of arrears.  They take levy in thousands and crores of rupees after every  BS,  but how and in whom they spend such a large amount  is known to none and  none of staff have courage to ask questions to their unions on this issue.  Improper  use and misappropriation of such fund is questioned by none of members  seriously. 

Obviously  they were  and they are never honest even for those employees  who are working and who are paying monthly  subscription  to them. Every bank has a check off system  and accordingly  these unions get participation in Bipartite settlement talks.  There is no place for retirees there. 

As such retirees may go on abusing and accusing  unions for decades and get no outcome, what they  will conclude. Similarly  IBA has told repeatedly  that they are not authorized  by banks to talk on issues  related  to retirees.  If still we are hopeful of positive  outcome  from unions and IBA, then only God knows when this trust will yield fruits. 

So far as AIBEA is concerned , old bankers, particularly  officers know very well that AIBEA used to be concerned  only for award staff and they used to first arrive at settlement on wages with IBA and then Officers could get similar or lesser hike.  They never bothered  that officers are supposed to get a little higher  amount.  Due to this,  you will find that total wages  of officers almost came closer to what their  counterpart in clerks used to get and outcome was that clerks stopped  accepting or opting for promotion.  Officers continued to shoulder higher and higher responsibility but their compensation  gradually  got eroded after every subsequent settlement . 

As such I personally  do not expect fruitfuls  results  from AIBEA or from UFBU or IBA so far as issues pertaining  to retirees  are concerned. 

Even now AiBEA is overstepping  UFBU,  AIBOC sometimes take corrective  step but slowly backtrack. 

It is therefore  need of the hour that we retirees  understand  ground realities

Many of our friends have expressed their views on issues of retirees. It's always welcome. No doubt all issues need not have direction to court. Certain issues can be sorted out by continuous persuasion and follow up. 

We need patience and hope as the efforts by different retireees organisations are now more organised for last two years than what it was 5 years back. We shall achieve this by continuous follow up jointly. 

But issues of merger of special allowance with basic pension and pension updation are the two issues which involve about 5 lakhs retirees need to go to legal platform. But approach to HC and SC need very careful build up of the case with justification. 

Our sub committee for court cases comprising of seasoned activists to build up case suitably will look into it. UFBR will approach all authorities first and then proceed to court. Therefore, please have little more patience to support UFBR and avoid criticism. We all will put up our best efforts.

Final Summary of the discussions on the issue of Special Pay Merger
 

The following opinions have been crystalised from the discussions:

1) Primarily there are three Court Judgements in this connection: 1. SC Judgement dated 28.2.2019, 2. SC Judgement dated 20.2.2018, 3. Kerala HC Judgement of October 2019. 

It should be examined what action initiated post each judgments.
Thereby having a consolidated position, the issue need to be taken up further.

2. One registered society of PNB has also filed CONTEMPT PETITION LAST YEAR AGAINST CMD, & GM DGM OF PENSION & LAW DIVISIONS OF BANK' IN DIV BENCH OF SCI ON SOME ISSUES, & ONE OF THE ISSUE IS SPL ALLOWANCE. This has been admitted
by SCI and bank has submitted reply. Matter may come up for hearing after position  of lockdown is eased. 

3. Mr.O.P.Parasher quotes the keral HC judgement on Special  Pay, which pertains to Corporation Bank employees. But other banks can quote the example for decision in their favour.

4. R.K.Verma informs that one  CONTEMPT PETITION  is already in Div.Bench  of SC. He  states that SC order in  BOB V/S  G.PALANI AND OTHERS CIVIL APPEAL NO 5525 OF.2012 held  that 

1-Special pay has to be Part of Basic Pay for calculation of gratuity .  

2- Fixation of Pension & commutation of Pension on the retirement.

But Judgements not implemented in their spirit though  delivered in favour of retirees by Court. He concludes that Meet PM with a delegation.

5. Mr. S. P. Pahwa states  that five retirees  from Punjab, Haryana and Chandigarh,have filed a Writ Petition on the issue in Chandigarh High Court. 

6. Mr. Ashutosh has  submitted about filing of 3 cases in Lucknow bench, One in Delhi and one by them in Chandigarh. All are pending due to Lock down situation.
 He has felt that before going to  Supreme court  on this issue, we should wait for the verdict of these cases and concentrate on forming and strengthen the UFBR.

Conclusion:-

There has been good discussion on the issue of merger of Special Allowance in Basic Pay. Many learned friends have given their opinions and also referred to HC and SC decisions. So far only one decision from Kerala HC is available in the form of direction to Corporation Bank . 

The affected retirees are about 1.80 lakhs. O. P. Parasharji,  S. Pahwa ji  and Ashutoshji have clearly narrated the present status and future steps. We need to wait for few more months for judgements expected from three HCs as all are in hearing stage in next few months. In case of defeat,  banks are expected to come to Supreme Court. 

So till HCs decissions are recieved, our home work for arguments will be under process. Simultaneously our preparation for organisations build up will continue.
