Banks have lost many cases related to gratuity payments in labour court and paid difference of gratuity as per court order to many officers who have won the case individually.
But officer situated in similar position are not being paid similar amount only because they have not filed cases in any court. This is clear cut violation of right to justice, right of uniformity before law.
Banks give same scale of pay, allowances ,pension and gratuity to all as per set rules. But when there is misconception about any rule, bank employees have to approach judiciary for justice.
When justice is delivered in one or hundred cases, bank cannot deny same benefits to those officers who have not filed cases in court due to some reason or the other bu who are entitled for enhanced amount of gratuity as directed by labour courts in individual cases.
Banks are willfully ignoring claim of such officers and they clearly say that they will make payments only to those employees who have filed case and won.They know very well that all employees are governed by same gratuity act and same rules framed by bank management and hence as per principles of justice all similarly placed employees are entitled for payment of difference amount.
It means banks are interested in increasing litigation and they are getting indirect support from Ministry of Finance.
Hundreds of cases filed by aggrieved officers individually are in process of final order in office of ALC or RLCs in various states.
I request you sir to please look into the matter, call for copies of orders passed by various labour courts in various districts against various banks , get it verified by your Law Ministry and finally seeking opinion of MOF, please give proper direction to bank management and show respect to court orders.
