Dear Sir,

My grievance registered with Prime Minister’s Office with registration No. PMOPG/E/2020/0264874 dated 30.03.2020.

The above grievance related to my letter No.334:19 dated 12 September, 2019 addressed to you, which was unresolved in spite of the lapse of six months.

The status report showed that the grievance was entrusted by Prime Minister’s Office on the date of registration itself, i.e. 30.03.2020 to Shri. Ambuj Sharma, Under Secretary (Public), Public Wing, Rail Bhavan, New Delhi for examination and redress.

Shri. Ambuj Sharma could not address the issue but since the issue was cogent, he took swift action on 14.04.2020 and closed it at his level with the reason “case already taken up for examination”. Another case status showed that the grievance was received by Shri. Shailender Mohan Pathak, Section Officer, Dept. of Financial Services on 09.04.2020. Presumably, Shri. Ambuj Sharma was sending the grievance to Shri. Shailender Mohan Pathak, Section Officer of DFS on 09.04.2020 and showing the date of disposal as 14.04.2020. It is unintelligible as to how a section officer of DFS could resolve the complaint against wrongs committed by his higher ups in the Department.

The case status “Under process” with date of action 25.04.2020 for the grievance shows that Shri. Shailender Pathak also failed to dispose of the grievance at his end and passed the buck onto the Manager, Indian Banks’ Association as is evident from the e-mail address viz. hr@iba.org.in appearing in it with instructions viz. “Please issue acknowledgement and furnish reply to the petitioner after examining and settling the complaint as per the rules.”.

The entire mischief was done by MOF and it was ludicrous that MOF sent the grievance to Indian Banks’ Association which cannot resolve the issue unless specific instructed to do so. I therefore make a request that MOF may kindly be instructed to rectify the wrongs done at its level by advising IBA to give effect to the notification to the extent it is valid and to repeal the impermissible clauses viz. 3, 3 (b) and 8 (b) of the notification. In case MOF has difficulties in repealing the impermissible amendments to the Pension Regulations, it may be asked to do the needful to pay the benefits notified as payable vide clause 4 and 8 (a) of the notification, which will suffice the requirement.
