News on Pending Demands

आज दिनांक 28-7-2019 को आल इन्डिया पंजाब नैशनल बैंक पेंशनर्स एवम रिटायरीज एसोसिएशन(रजिस्टरड) हरियाणा राज्य का एक डेपुटेशन श्री मनोहर लाल अरोड़ा जनरल सेक्रेटरी,श्री रविंद्र सकसैना कोऑर्डिनेटर,श्री हरीश चन्द्र आजाद संगठन सेक्रेटरी,श्री हरिशचंद्र मनचंदा  फेडरेशन सेक्रेटरी द्वारा श्री जे पी नड्डा  कार्यकारी अध्यक्ष, भारतीय जनता पार्टी,एवम श्री सजय भाटिया  सासद करनाल को अपनी निम्नलिखित मांगों हेतु ज्ञापन प्रस्तुत किया।

१. हमारी मुख्य  मांग पैशन अपडेशन करने की है । जो कि 1993 से अब तक समझौते के बावजूद  कभी भी अद्यतन  नहीं  की गई ।

२.फैमली पैशन को केंद्रीय कर्मचरियों के बराबर  वेतन का 30% करना।   
  
३.दिनांक 1-11-2002 से पहले सेवानिवृत्त होने वाले कर्मचारियों के  महगाई भता को कम न दे कर पूरा १००% दिया जाए ।

४. दिनांक 1-11-2012 के बाद सेवानिवृत्त होने वाले कर्मचारियों की स्पेशल पे की पैशन में गणना की जाए।

५.   स्वास्थ्य बीमा पॉलिसी योजना में पेंशनर से बीमा के प्रीमियम के भुगतान उनसे ना लेकर  वर्किंग कर्मचारियों की तरह  बैंक द्वारा ही वहन किया जाए l

६ .केंद्र सरकार ने ग्रेच्युटी का जो नोटीफिकेशन जारी किया है उसके अनुसार केन्द्र सरकार के कर्मचारियों को ग्रेच्युटी का लाभ बीस लाख तक दिनांक 1-1-2016 से देय है,जबकि बैंक कर्मचारियों को दिनांक 29-3-2018 से देय है। हमारी मांग है कि बैको में भी दिनांक 1-1-2016 से बीस लाख ग्रेच्युटी  देय हो ।

७.भारतीय रिजर्व बैंक ने दिनांक 1-3-2019 से अपने सभी कर्मचारियों एवम अधिकारियों की पैंशन का संशोधन कर दिया है। श्री नड्डा जी एवम श्री भाटिया जी ने सभी मांगों को ध्यान पूर्वक सुना और आश्वासन दिया कि सभी मांगो की श्रम और वित मन्त्रालय को अपनी सिफारिश सहित भेज दिया जाएगा।

Good afternoon friends,
Your would have noticed that now a days so many messages are being circulated in the name of one organization or the other. Please note that both  organizations  and issues existed  even earlier but both were in hibernation mode.

The difference that has come after  2018  is that you all have come together and initiated a movement which has  built up tremendous pressure on the Govt, RBI , Banks and IBA . It started with an idea of challenging the   Government’s decision on effective date of Gratuity   w.e.f. 01.01.2016. A lot of hard work was required to ensure that this case is admitted in the court of law.  Sensing some foul play/mischief, we even resorted to withdraw the petition after filing through a smart move. We adopted other route of article 350 and filed this petition again  .

Now this time it got admitted.  Many eyebrows were raised amongst various organizations of retires or otherwise. Some messages started pouring in that some leaders from associations or unions have met the Labour Minister and shortly some favourable announcement will be made . This will make enhanced Gratuity effective w.e.f. 01.01.2016. Actually, It was face saving exercise  by the so called leaders . If their claim was right something would have come by now. So not believing all this propaganda,  we continued this fight.
After this,  some decisions came from ALC Silchar, Ranchi and Hyderabad on the procedure of calculation of Gratuity.  Kalia ji and me , after due deliberations , decided to  put forwards our proposal before all of you that it is another fit case for the legal battle . You all gave your nod to contest this case. Accordingly,  after doing the necessary home work this  2nd case was also filed .  Fortunately, we succeeded in getting it admitted too.

Then we thought of going for one more litigation regarding  Spl allowance and updation/revision of Fortunately we came across a Supreme Court verdict on this matter.  After taking permission from all of you , we filed this petition and this too was admitted. This was a third case in a row that got admitted in the court.
Here I must point out that during this period , many people have contacted us regarding all these cases, they have taken clues and sometimes requested to  share the drafts of these cases. We believe that such people or organizations are also fighting this battle genuinely and honestly. We applaud their efforts.

But what about the organizations who are responsible for signing the B.P. Settlements and under whose nose all these anomalies have arisen and continue to exist till date.
Actually these are the people who are fearfully sensing that some favorable judgments may come in near future.  Foreseeing all this they are sending such kinds of messages to tell the people that they are the main architect of such decisions.

So, please do not get carried away or complacent. We may tell you that shortly we are going to file yet another case on leave encashment.  It is totally wrong on the part of  the Govt  to have different Income Tax  laws for different set of employees .




My idea of sending this message to all of you is

(1) that all of you need to be together till win all the cases  and
(2)  that you can take pride in being the architect of these changes which are going to happen in banking industry in the  near future . You all have stood together and given us moral and financial  support. It is because of  this that we have been able to create  pressure on the various Ministries like Finance, Labour, Law and Justice along with  RBI, IBA and various banks . They are visibly in dilemma and upset due to ongoing pressure. There may be attempts to divert your attentions by presenting rosy pictures as if  everything is around the corner but believe me it is not so easy to get the desired result. Had it been so,  we would not have resorted to the long legal battle.   Even the Govt and these organisations knew that they  were wrong but nobody dare to challenge them in the past.

So friends, do not be complacent and do not believe all these circulars, enjoy them, keep an eye over the situation and continue to fight till we get justice.  Your togetherness is our strength. Here you are all leaders . We are just a few among you all.



All that you are going to get in the near future,  will be solely because of your untiring collective efforts . Although you do not have any registered organization but what you have done so far  is much more than what these so called organization have done in the past.

Kaliaji and me  express our sincere  gratitude towards  all of you for your contributions in this respect. We also applaud the others who are genuinely fighting elsewhere. My request to all such people is that do not make is self-centric, put up a fight which benefit all and not   only a few.

Public sector bank employees ask PMO for help on pension update demand

A delegation of Forum of Retired Bank employees met with Finance Minster, Smt Nirmala Sitharaman for the long pending demands of retired bank employees :

1. Updation of Pension. Bank employees pension is not updating along with wage revision. Whereas central government employees pension is updating along with their Pay revision. For RBI employees also govt has given pension revision.

2. Improvement of Family Pension : For bank employees family Pension is also very less i.e. 15% of last basil with cap. Whereas for Central Government employees it is 30% without cap.

3. 100% DA neutralisation to pre 1.11.2002 retirees.

4. Pension to Bank Resignees : Bank employees after putting 20 years of service (eligible for pension) are denied pension option.

5. Group Mediclaim Policy for retirees. For retired bank employees premium is very high. We demand that Bank management should born the medical insurance premium as per working employees.

Hon'ble Finance Minister assured to  consider the issues.

Bank Pensioners, are stuck in most confused, uncertain & gloomy situation with regard to their issues, be it Pension/family Pension revision, 100% DA or mediclaim. 

They are trapped in a net of their working brothers & their Associations, that's the crux of whole issue. 

Pensioners Unions are a handicapped lot, no striking power of their own, their out reach ends at the door steps of their mentors, that's the end of their endeavor. None of them have political out reach of eminence or support that matters their task.

In fact, operating Unions, all along, maintained a conscious distance from Pensioners Unions by disassociating them from their movement or allowing them to share dish with them. It's quite contrary to a situation that existed in RBI, where unique and unisome coordination has been maintained between working and pensioners unions and with this they could give a clear message to RBI management and government that retirees tasks/issues are not different to regular employees. Pensioners eee are equally good and important as of RBI regular staff. 

In last 25 years, we find  no instance where operating Unions associated or coordinated with Pensioners causes or allow their presence in negotiations with IBA. This created a clear divide scenario between retirees & existing workforce, with regard to their issues. 

It is popular belief of entire working fraternity that their Unions have their own problems & priorities. They are more subservient to political issues to please their political masters than the problems of Banking or its workforce. This very attitude shadowed the real issues of banking industry or its workforce. A new kind of approach has emerged over last two cades to have a settlement by compromising basic tenets and article of faith imbibed by trade Unions.  Sacrificing just & comparative compensation, for the people they represent, has become the order. This led to frustration, discontentment, anger and disbelief in bilaterism, which culminated into vociferous demand for Pay Commission for Banking, as existing  bilateralism totally fell short to meet the expectations & aspirations of bank employees. 

People put forth land mark question that when in 1970 bank employees and officers were paid better than their counter part in Central Government and they were called 'high wage islander', how today they trail far behind? Is it deliberate or by some fault in system which Unions followed to determine wages & service conditions?

There is hegimony war in UFBU. It is defunct now. This trouble was brewing since last several years. Here, failure of one section can be applauded by other, one may cheer on other's tear, but it all caused immense damages to collective goods. It has strengthened the management beyond proportions. 

Here, in instant case let us share the truth that adventurism or romanticism proved not only futile, but caused incredible loss to trade union movement, here in banking. In last five decades, never such a situation we came across, where having done two days strike followed with massive dharana in Capital, leaders had to come down on knee and beg of management, but shown exit gate. It's an ugly situation of two stalwarts locked in horns to establish hierarchy in organization. 

Given the ground situations wherein (i) Pension is termed as bilateral issue, (ii) IBA discusses only the mandated issues & Banks have not give mandate for pension revision, (iii) IBA' tough attitude shown towards officers mandate, (iv) financial difficulties of Banks and last but not least the attitude of UFBU constituents towards Pensioners issues, be it Pension/Family Pension revision, 100% DA case, Medicinal insurance etc.

 Pensioners have nothing to hope. So far none of the Unions, IBA or the Government executives opened their lips. Few of them just appeased & amused. No mandate for scale iv-vii became the issue of direct action, but no mandate in Pension revision matter, they all 9 together maintained stoic silent.

 The darkness shrouds the Pensioners. Over Lakh had died in awaiting dawn, lakhs are under multiple death trap in absence of medical support, rest suffer from financial distress on account of paltry sum of unrevised pension. Worst hit case is of family pensioners. 

It's the situation in an industry where we have switch organizations. We don't know, how to write obituary of Golden Era of great people & movement, who achieved unachievable Pension Scheme surmounting all hurdles....once upon a time..!
