LOGICAL REASONING DID PAY DIVIDEND
HIGH COURT ORDERS FOR INCLUSION OF SCALE I OFFICERS
RECRUITED UP TO 04.07.2011 FOR THE PROMOTIONAL PROCESS
In the background of management of the bank failing to see
the logical presentation of our request to include officers
recruited up to 04.07.2011 for the promotional exercise
from Scale I to II and also the unscientific stipulation of securing
APAR marks of 75% every year instead of average of three years
as per the Government Guidelines, our organisation, after due
deliberations with AIBOA leadership preferred to seek legal
remedy in the Hon’ble HighCourt of Madras.
2. Our case was filed in the first week of May 2014. During the
summer vacation, the court handles urgent cases only and hence
it came up on 5th June 2014 for hearing. The Hon’ble Judge gave
an interim relief to allow the new recruits joined up to 04.07.201
1 to participate in the examination scheduled to be held on
8th June 2014. However, the results shall not bepublished
until further orders from the court.
3. Management preferred to maintain stoic silence and did not
adhere to the court directives. The other officer organisation
had two rounds of IR meetings in the month of July and August
2014 and failed totally to resolve the matter. Instead, they blamed
our organisation as ‘UNSCRUPULOUS ELEMENTS’.
4. YES, it is a well known fact that their representative was present
in the Board meeting when the differential treatment was meted
out in respect of APAR marks to Scale 1officers, contrary
to the Government guidelines. Rather the leadership of the
Federation had utterly failed to incorporate the best provision
available in Punjab National Bank andalso of Corporation
Bank.
5. Having the Federation failed, to clinch the issue between
05.06.2014 till October 2014 with the management, was compelled
to fall in line with line of action taken by our organisation
and ultimately they impleaded as a party in the case. There were
5 hearings and ultimately on 21.11.2014, the argument
by our lawyer lasted for nearly 2 hours followed by a mere and
meek supplementary submission of early disposal of the case
by the Federation’s Counsel. The Hon’ble Judge declared
that the Judgement was reserved.
6. Today, the case came up for final judgement and the court
directed to include batch of Scale 1 officers joined up to 04.07.2011
to participate in the promotion process thereby the net result of the
situation is that the cutoff date fixed by the Bank stood scrapped.
The time limit stipulated for implementation of the above
judgement is 8 weeks.
7. Our organisation is certainly for the GEN NEXT as the industry
is leaping towards a transition era with the regulator (RBI) is in
the process of changing the gears and also the direction
of the Banking.
8. While we claim the success of the efforts put in through
legal intervention, still we strongly feel that there is certainly
the space for improvement of the APAR marks as it is one of the
"tool / factor" considered for promotion from one scale to another.
Other Banks like PNB and Corporation Bank have brought
in favourable changes suitable to the officer community,
even scaling down the APAR marks to 40%, why not the same
facility in our Bank? We shall certainly pursue this matter with
the management for appropriate amendment to facilitate
more number of officers to participate in promotional exercise
as we strongly believe that APAR marks is not a tool to eliminate
officers from participating in the promotion exercise.
To conclude,
All Glory to your faith in our organisational capacity to intervene
to get justice to the affected young officers.
All Glory to the AIBOA leadership who promptly and properly
guided our organisation to convince the judicial apparatus
with reasonable and realizable arguments.
