An Appeal To Supreme Court in Matter Related to CJP protest

Advocate kapil sibbal who is fighting on behalf for f Protestant in Delhi says that due to internet stoppage public work is adversely affected.
Why does he not understand that the proposed agitation could further damage entire business activities across NCR due to protest crowd and violence against police. It dropped the morale of police, and caused huge loss to not only business community but also poor rickshaw pillars, Toyota dr era, thela food sellers, ola cabs, vegetable vendors like several low level daily income earners.

Similarly kapil Sibal says that due to vlosure of metro services thousands of daily passengers face unlimited difficulty. But he does not remember how these protestors damaged metro properties and rail properties. That time they blamed government in failing to protect public property and protect passengers
In view of above an appeal to Supreme Court

BEFORE THE HON’BLE SUPREME COURT OF INDIA
(PIL / Public Grievance Cell / Registrar General)
MEMORANDUM / CITIZEN REPRESENTATION

SUBJECT: Urgent Need to Balance the Right to Protest with the Fundamental Rights of Daily Wage Earners, Commuters, and the Preservation of Public Order in the National Capital Region (NCR).
RESPECTFULLY SHEWETH:

Conflict of Fundamental Rights and Disproportionate Burden on the Vulnerable:
   While the right to peaceful assembly under Article 19(1)(b) is recognized by our Constitution, it cannot be exercised at the complete erasure of the rights of millions of ordinary citizens under Article 19(1)(d) (freedom of movement), Article 19(1)(g) (right to trade, occupation, and business), and Article 21 (right to livelihood and life). The brunt of prolonged arterial road blockades and transit disruptions in NCR is overwhelmingly borne by the most vulnerable economic segments—including auto and e-rickshaw drivers, street vendors (thela walas), cab drivers, and daily wage earners—who lose their entire livelihood without any recourse.
 * Settled Law on Public Roads and Transit Blockades:
   This Hon’ble Court, in Amit Sahni v. Commissioner of Police & Ors. (Civil Appeal No. 3282 of 2020), categorically held:
   > “Public ways and public spaces cannot be occupied in such a manner and that too indefinitely... Dissent and democracy go hand in hand, but protests must be carried out in designated areas only.”
   > Similarly, in Monicca Agarwaal v. Union of India (2021), this Court reaffirmed that highways and key transit routes cannot remain perpetually blocked, as it severely impinges on public life and economic activity.
   >
 * Inconsistency Regarding Public Utilities and Security Actions:
   Arguments contending that administrative curbs—such as Metro station diversions or preventive measures—cause unilateral hardship overlook the operational reality that law enforcement takes such steps precisely to prevent escalation, mob violence, and destruction of critical public infrastructure. Past agitations have resulted in severe damage to railway lines, metro stations, and public buses, leading to long-term closures and heavy losses to the national exchequer. Criticizing precautionary safeguards while ignoring the violence and intimidation that necessitated them presents an incomplete and skewed picture of ground realities.
 * Protest While Matters are Sub Judice:
   When the core grievances or legislative disputes are already sub judice and being actively adjudicated by this Hon’ble Court, resorting to mass disruption of public highways and urban transit to enforce coercive outcomes undermines the judicial process itself. The constitutional forum for redressal is the courtroom, not the coercive paralysis of regional life.
 * PRAYER / SUBMISSION:
   It is therefore most respectfully prayed that this Hon’ble Court may:
   * Enforce strict compliance with the Amit Sahni guidelines, directing that assemblies and agitations be strictly confined to designated protest grounds and not permitted on public thoroughfares, arterial highways, or metro corridors.
   * Ensure that the legitimate security assessments of law enforcement to safeguard critical transit infrastructure (such as Delhi Metro and rail networks) are given due weight against organized attempts to choke public mobility.
   * Protect the fundamental rights to livelihood and transit of millions of unrepresented commuters, vendors, and daily wage workers across Delhi-NCR.

(Precedents):

To,
The Editor,

Subject: Balancing the Right to Protest with the Rights of Commuters and Daily Wage Earners

Sir/Madam,

Through the columns of your esteemed newspaper, I wish to draw attention to the severe economic and daily hardships inflicted on ordinary citizens whenever large-scale agitations spill onto public roads and transit networks in Delhi-NCR.
While the freedom of expression and peaceful assembly is an essential democratic right, it cannot be absolute or exercised by holding the entire capital region to ransom. When arterial highways, city intersections, and metro stations face closures, the loudest impact is felt not by policy-makers, but by the most vulnerable sections of our society—e-rickshaw pullers, cab drivers, auto drivers, roadside food vendors, and daily wage earners who lose their only source of survival for the day.
Legal arguments often fault the administration for shutting down transit lines or imposing traffic diversions. However, one must recognize that law enforcement is forced into these precautionary measures precisely to safeguard critical national assets like metro and rail infrastructure from mob violence and arson. Criticizing precautionary safeguards while overlooking past destruction of public property presents an incomplete picture.
The Supreme Court of India in the Amit Sahni (2020) ruling held in unambiguous terms that public roads cannot be occupied indefinitely and that protests must be restricted to designated grounds. When grievances are already being adjudicated before constitutional courts, bringing normal city life to a halt serves no constructive purpose. Public thoroughfares must remain open for the millions who rely on them for their daily bread.
Yours sincerely,
