Writ Filed Against Wage Settlment

By Kamlesh Chaturvedi Expresses his views on Xth Bipartite Settlement signed BY IBA and IFBU

As part of our ongoing efforts to secure justice for Bank Employees, We Bankers filed another Writ before Hon'ble High Court engaging same Senior Lawyer Sri Vijay Mahendra who filed first writ and argued for Order dated 18.05.2015. This time we made Sri Rakesh Khare an eminent trade unionist as Petitioner and challenged the reduction in Pension to the detriment and disadvantage of Retired Bank Employees. We linked this writ petition with our Industrial Dispute and referred th...e letter dated 22nd May written by Sri Subhash Sawant, General Secretary INBEF to Chairman and Convenor of UFBU giving examples of reduction in Pension and citing case law requested UFBU to take notice and make necessary amendments and UFBU did not take care of voice of Sri Subhash Sawant. Hon'ble High Court has made it clear that Settlement is subject to the decision of writ petition.

Thus, in view of the orders of Hon'ble High Court, 10th BPS has become sub judice. Now this settlement has to undergo scrutiny and review of both CLC and High Court. We Bankers has also proved that it is equally concerned for retired bank employees.
Now its time to strengthen We Bankers and launch a sustained struggle to give jerk after jerk to retired and tired leaders who compromised and surrendered before IBA and to achieve our demand of coverage under CPC.

We have asked our Advocate Sri Vijay Mahendra to send us copy of the prayer for satisfaction of retired employees. Please bring orders to the notice of retired employees and attain their support.

Met Dy. CLC today, had discussion with him for half an hour, argued harmful, detrimental and disadvantageous impact of BPS on bank employees which got signed only due to inaction and collusion, made him aware of growing resentment and call for strike and pleaded that for the sake of sanctity of provisions of Industrial Disputes Act, grievance redressing machinery must perform its duty to maintain industrial peace and harmony.
Dy. CLC has assured that notices will be issued with in 2-3 days from Monday by fixing the date for conciliation proceedings.
So let us hope that good senses would prevail and investigation would be made to bring out inside hidden story of betrayal.

  3. Sir, will somebody clarify that noble act filing the writ against x bps ignoring the retirees incluedes those who took volunatary retirement in 2001 under svrs. We wholeheartedly support the cause

    Please forward these to smt, smruti irani, sri narendra modi, sri arun jaitely.
    Ufbu's collusion should have alerted aiboc and aiboa. But, that had not happened. Let us hope for the best.

We should teach a lesson to the treacherous conglomeration of IBA UFBU and associates by filing contempt cases for not inviting Retiree association inspite of clear instructions from courts A new settlement with Retiree associations participation and satisfaction should be our aim for the direction from courts.

I think aibrf is a branch of aiboc which is part of ufbu that is why aibrf os not filing any case in court for 100% DA neutrilisation of pre nov 2002 Retirees and for updation of pension.licretirees fedration is nice to file cases in courts. Aibrf sites donot seeks comments from retirees bur are working in a secret way and follow the guidence of aoboc or aibea

  8. I agree with you. Their continuous silence without any action appears to suggest they are giving only lip service. We banker is reportedly filed writ in Allahabad high court under no.33050/2015 but would not give further details. Whom to believe.
